BATTLE OF THE BEATS - Dancing Competition
Registration-2024
1. These terms and condition govern the registration process for participating in the Competitions conducted for the dancing reality Competition “BATTLE OF THE BEATS– 2024”- DANCING COMPETITION (“Competition”) organised by “Cizzara Cineart” & "The United Production".
2. Participation is restricted to residents of India and who are 6 years and aboveand anybody who can present their talent based on Dancing skills.
3. Every person who fills the Registration Form is referred to as an “Applicant”.
4. To participate in the Competition, the applicant shall fill the Registration form with all the details precisely then after, Applicant shall be required to upload the online Competition video of their performance which will be considered to be their first round of Competition.
5. The Online Registrations will end on 5th NOV 2024.
6. There can be three types of entries and registration fees will vary accordingly:
a. Solo Junior (6-12 years)
b. Solo Senior (13 & Above)
c. Duet Performance
d. Group Performance
7. If the Applicant(s) does not submit the Registration Form during the Registration Period, then such Application shall not be considered as valid for this purpose of the Competition Registration and such Applicant shall be disqualified.
8. The first round of Competition will be virtual/online on our official website www.cizzaracineart.com where participants will have to upload their performance video and after the shortlisting from the same, the participant will receive a confirmation mail. The mail will include the details of the venue for Semi-Final and the Finale rounds.
9. If any Registration Form is not completely filled, then Cizzara Cineart shall consider such Application as invalid and such Applicant will be disqualified. Cizzara Cineart shall have no further liability towards such Applicant.
10. Submission of Registration Form in Competition does not guarantee, participation in the Semi-Final and the Finale rounds the same shall be the sole discretion of Cizzara Cineart.
11. Each Applicant shall participate voluntarily at his/her own risk and shall have no claim against Cizzara Cineart or its agents, affiliates, permitted assigns whatsoever in relation to the Competition process, any damage, loss or any form of mental or physical harm or injury caused to the Applicant and/or guardian.
12. The number of Performances, the criteria for selection to further rounds of Competitions shall be determined by Cizzara Cineart at its sole discretion and Applicant shall not raise any concerns regarding the same.
13. In the Competition if an Applicant has submitted more than 1 (One) Application, then only the first Application submitted shall be considered for the purpose of evaluation by Cizzara Cineart.
14. It is hereby clarified that depending on the number of Application(s), Cizzara Cineart may require to call the Applicant(s) for Competitions on another day and Cizzara Cineart shall not be liable in any aspect towards the same (including any costs, expenses incurred by the Applicant(s)).
15. Selection of an Applicant in one round of Competition does not imply selection of the Applicant to further rounds of Competitions that may be conducted by Cizzara Cineart in relation to the Competition. Such selection of the Applicant(s) in the Competitions shall be the sole discretion of Cizzara Cineart.
16. Cizzara Cineart reserves the sole right to disqualify any Applicant at any time and the decision of Cizzara Cineart shall be final and binding on the Applicant.
17. To participate in the Competiton, Applicant shall compulsorily be required to carry with them the following documents:
a. Their Legal Identity proof with the Proof of permanent address of their major parents/guardian i.e. Permanent Driver’s License/Passport for address proof/ Birth Certificate/ School Certificate as may be required by Cizzara Cineart. These Identity Proofs will also confirm the age of the applicant.
b. 2 passport size recent photographs will be required for the reference.
18. Application hereby assigns to Cizzara Cineart the perpetual, worldwide right to make both audio, visual and/or audio visual recordings and take still images of the Applicant(s) during the Competitions or at any other time in relation to the Competition or otherwise in relation to the Competition Registration (“Recordings”) and to use the Recordings including but not limited to alteration, editing, dubbing and amending the Recordings and the Applicant(s)’s name, images, voice, likeness, performance and biographical information in connection with the Competition or otherwise and also for the purpose of promoting the Competition on any mode, medium, format whether in existence now and which may come into existence in the future. Applicant further agree that the rights granted hereunder shall include the perpetual, worldwide right of Cizzara Cineart to exploit the Competition and the Recordings in any manner, in whole or in part and in any mode, medium, format whether now known or which may come into existence in the universe in the future in lieu of the consideration i.e. opportunity to register and /participate in the Competitions. You acknowledge that in the event assignment in future mode, medium, format is considered invalid for any reason under any law or equity, then in lieu of the consideration received, the sufficiency of which is hereby acknowledged, Applicant hereby grants to Cizzara Cineart for worldwide perpetual term, an exclusive, irrevocable, license in all the rights in the Recordings assigned herein, to use in any manner If the above mentioned license is considered ineffective in any manner, Applicant agrees to provide any ratifications/consents as may be deemed necessary to accomplish the purposes of the foregoing in favour of Cizzara Cineart, as requested by Cizzara Cineart.
19. Applicants are advised to carry one water bottle, medicines (if required) and food for themselves during the Semi Final and the Final rounds for those who are qualified in the online Competition and Cizzara Cineart shall not be responsible in providing any meals or any provisions whatsoever in the Performance venue.
20. Upon registering the Application, the Applicant hereby confirms and acknowledges that all the terms and conditions provided herein are accepted and understood by the Applicant and the Applicant shall, at all times, adhere to the same.
21. Cizzara Cineart, at its discretion, may reject or select the Applicant’s performance including but not limited to the right to ask the Applicant to repeat any number of performances for any number of songs in the style and manneras may be relevant for the Competition and/or required by the jury of the Competition.
22. The Applicant / the guardian shall not be entitled to or give any form of remuneration with regards to the Competition and/or the Competition to Cizzara Cineart or any third party. Any discovery of such maleficence shall lead to the disqualification of the Applicant immediately.
23. Grounds for disqualification:
a. Applicant(s) failing to provide the required documents during the Competitions or otherwise as required by Cizzara Cineart.
b. Applicant found to be below 6 years as per the age proof submitted.
c. Any of the documents/proofs not being properly attested, unclear, illegible and/or Cizzara Cineart has reasonable grounds to believe the same to be fraudulent.
d. Any conflict of interest or found to be bound by any contract or arrangement which may prohibit the Applicant from entering into a contract with Cizzara Cineart with regards to the Competition (if selected) including but not limited to management contract, recording contract and/or merchandising contract, performance contract.
e. Any disability to perform or participate, involvement in criminal offence and/or under inquiry or trial by the relevant authorities or any court of law and has failed to disclose the same to Cizzara Cineart prior to the Competition.
f. Any person who is an employee of Cizzara Cineart or any of its subsidiary, affiliate, parent company shall not be eligible to participate and if participated shall be disqualified by Cizzara Cineart.
g. Disclosure of confidential information including but not limited to uploading any pictures or information on any social media platforms without the prior written consent from Cizzara Cineart.
h. Without assigning any reason, Cizzara Cineart retains the right to disqualify any Applicant at any stage of the Performance and/or Competition.
24. Neither Cizzara Cineart nor any of its affiliates or group companies shall be liable for any damage or loss (including but not limited to indirect, punitive or consequential loss) arising from personal injury or death, or loss of, or damage to property, which is suffered or sustained in connection with the participation and/or elimination herein or any aspect of the Competition and further neither Cizzara Cineart nor any of its affiliates or group companies shall be responsible for any consumer grievances with respect the participation for the Competition.
25. Applicant shall be solely responsible to bear all costs, expenses in relation to the Competition Registration, Competition, participation, Competition process including but to limited to costs and expenses relation to travel, accommodation, food etc. and Cizzara Cineart shall not be liable for the same in any manner whatsoever.
26. Cizzara Cineart at its sole discretion reserves the right to modify the terms and conditions relating to the Competition Registration/Competition from time to time and/or suspend, shorten, modify, extend or cancel the same without prior notice, without stating any reason and no claim in this regard shall be entertained. Cizzara Cineart reserves the right to change, defer, alter or cancel the Competition Registration/Competition, Competition etc. in part or full, for reasons beyond its reasonable control or/and at its sole discretion without giving any reason and Cizzara Cineart decision shall be final and binding. Cizzara Cineart shall not be liable in any manner whatsoever for cancellation of the Competition Registration/Competition or the Competition.
27. The Applicants hereby undertake to sign such documents as required by Cizzara Cineart from time to time in and agree that refusing to sign the letters required by Cizzara Cineart shall deem withdrawal of the Applicant from the Competition Registration/Competition and/or the Competitions and Cizzara Cineart shall have no further liability towards such Applicant(s).
28. Applicant hereby undertakes to not issue any public statements that may be derogatory or prejudice the reputation of Cizzara Cineart, all participating sponsors, agents, directors, affiliates, employees, subsidiaries, parent company etc.
29. Technology Limitations – all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries/ posts; (b) electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any disruptions, injuries, losses or damages caused by events beyond the control of Cizzara Cineart.
30. Each Applicant declares hereby that he/she/other is a real person in existence and not a computer programme.
31. Cizzara Cineart does not and shall not subscribe for any claims / disputes / confirmation / responsibility in respect of the CompetitionRegistration/Competitions including these terms and conditions and any breach thereof.
32. Each Applicant expressly agrees that by his/her participation in the Competition Registration/Competitions, Cizzara Cineart and/ or its affiliates/ agents/ advisors or sub-contractors further can use the personal, sensitive collected information, in any media or future promotional, publicity and marketing material, without any consent, reference, payment or other compensation to the Applicant, subject to applicable privacy and data protection laws.
33. Cizzara Cineart shall have the right to share the Applicant’s personal information to any governmental or regulatory bodies if required by law, rule or statue and in response to a valid order of a court or authorized agency of the government or other legal process.
34. Cizzara Cineart takes appropriate technical and organizational measures to protect the personal information provided by the Applicant against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. However, Cizzara Cineart cannot guarantee the security of any personal information or data which the Applicant discloses. In any event, Applicant agrees not to hold Cizzara Cineart responsible for any breach of security, except in case of negligence or wilful default on the part of Cizzara Cineart under the relevant legislation.
35. Using of false names/ identities, illegal/false mobile numbers, fake email addresses and/or any other illegal means either online or in hard copies shall be considered as suppression of facts and if Cizzara Cineart has to suffer of any adverse consequence in this respect, the Applicant/s shall be penalised for the same in a manner as Cizzara Cineart may deem fit.
36. Applicants found indulging in any malpractices such as cheating, misrepresentation, providing false information shall be disqualified from the on-going Registration/Competition and strict legal action may be taken by Cizzara Cineart against such Applicant(s).
37. All disputes arising out of or related to this Registration/Competition shall be subject to the exclusive jurisdiction of courts at Vadodara alone and subject to the laws of India only.
38. The Applicants shall indemnify and hold Cizzara Cineart and its group companies, affiliates and subsidiaries and their respective officers, directors and employees harmless, against any loss that may occur to them due to non-adherence of these terms and conditions and the other terms and conditions as contemplated herein to be complied by each Applicant.
39. Unless otherwise expressly stated, all rights, titles, interests, intellectual property rights, copyright, database right or similar rights in all material in relation to or/and relating to the Competition or any aspect of the Competitionor part thereof (including graphical images, text, video clips, demographics, sounds, demos, patches and other files) is owned, controlled or licensed by Cizzara Cineart or its affiliates and is protected or covered by copyright, trade mark, intellectual property law and other proprietary rights. Unless with prior permission, no part of the such materials/Registration Form/Competitions may be reproduced or/and transmitted to or stored in any other website/platform/device/mode/medium, nor any of its pages or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service.
40. The decision of Cizzara Cineart on all matters, queries or disputes, concerning the Registration/Competition including the selection of Applicants for the Competition, the number of rounds of Competition conducted, the criteria for selection for further rounds of Competition and the terms and conditions shall be final and binding and no correspondence shall be entertained in this regard.
41. Judges panel as well as the chief guest are subject to their availability and the sole authority for their selection is with Cizzara Studios and that can’t be a reason for cancellation of participation won’t be considered a valid reason and no refund will be allowed on the same.
42. You agree to provide us with true, complete and up-to-date information about yourself as may be required for the purpose of completing the Transactions. This information includes but is not limited to the personal details such as name, email address, phone number, delivery address, age, and gender (or any other information that we may deem necessary for us to fulfil the Transaction) as well as the accurate payment information required for the transaction.
43. By participating in the Competition Registration, each Applicant acknowledges and agrees to the terms and conditions contained herein and all related terms and conditions governing the Competition Registration/Competition. The duration and other rules/regulations of the Competition Registration/Competition shall be at the discretion of Cizzara Cineart only.

The decision of Cizzara Cineart on all matters, queries or disputes, concerning the Registration/Competition including the selection of Applicants for the Competition, the number of rounds of Competition conducted, the criteria for selection for further rounds of Competition and the terms and conditions shall be final and binding and no correspondence shall be entertained in this regard.
41. Judges panel as well as the chief guest are subject to their availability and the sole authority for their selection is with Cizzara Studios and that can’t be a reason for cancellation of participation won’t be considered a valid reason and no refund will be allowed on the same.
42. You agree to provide us with true, complete and up-to-date information about yourself as may be required for the purpose of completing the Transactions. This information includes but is not limited to the personal details such as name, email address, phone number, delivery address, age, and gender (or any other information that we may deem necessary for us to fulfil the Transaction) as well as the accurate payment information required for the transaction.
43. By participating in the Competition Registration, each Applicant acknowledges and agrees to the terms and conditions contained herein and all related terms and conditions governing the Competition Registration/Competition. The duration and other rules/regulations of the Competition Registration/Competition shall be at the discretion of Cizzara Cineart only.
